On March 19, 2020, the Emeryville City Council adopted a temporary moratorium on residential and commercial evictions due to nonpayment of rent and foreclosures initiated by Homeowner Associations due to nonpayment of assessments, due to the COVID-19 pandemic. The moratorium does not relieve the tenant from the obligation to pay rent, but provides that tenants cannot be evicted for not paying rent during the term of the moratorium. The moratorium is effective as of adoption (March 19, 2020) and expires on May 31, 2020 unless otherwise extended by the City Council. The full text of the ordinance enacting the moratorium can be found here. Additional guidance on the ordinance will be posted soon.
